Refunds
Unopened Products
Changed your mind? That's fine. We will happily accept returns of goods that HAVE NOT BEEN FITTED or USED IN ANY WAY, providing that we receive your return request within 14 days of the PURCHASE date.
Please note that we do not refund our original postage costs with the return. To return a product, please follow the simple steps below:
email us to let us know you would like to arrange a product return. We'll advise the best address for you to send the products to.
Pack and seal the item/s in their original shipping package (in an extra box or padded bag) and post them back to us.
Please include a note with all your details including invoice or order number and the reason why you are sending it back to us.
Provided that we receive the products in their original condition and they HAVE NOT BEEN FITTED or USED IN ANY WAY, we will arrange for the original purchase price (not including original postage cost) to be refunded to the purchaser's credit card or PayPal account. Please allow up to 14 days from the date we receive the returned goods for the refund to be processed.
Please note for all special order items and build to order items we do not offer a change of mind return or refund.
Damaged or faulty products
We take care to pack your items carefully so that they will not be damaged in transit. If, for whatever reason, they arrive damaged, we ask that you let us know within 7 days of receiving them in the mail. We'll arrange for the products to be returned to us at our cost and a replacement will be sent out to you.
Opened products
If you have purchased a part without our advice and it does not fit, you can return the item for an exchange. If the packaging has been opened, we may charge a restocking fee as the product will no longer be able to be sold as new. PLEASE CHECK WITH US BEFORE PLACING AN ORDER IF UNSURE ABOUT THE COMPATIBILITY.
Incorrect Address
If we are provided with an address that is incorrect causing the order to be sent back to us, once the correct address is confirmed a postage fee will be incurred for sending out the order a second time. This will be provided in the way of a PayPal invoice and must be paid before we resend the order again.
Warranty
All products sold by Classic Carburettors are, unless stated otherwise, subject to the product manufacturer’s warranty.
The obligation and expense of Classic Carburettors under this warranty is limited to the replacement of defective components and/or reimbursement at our own discretion.
New old stock (NOS) products are sold as is, without any warranties, express or implied, of any kind or nature, including, but not limited to, any warranties of performance.
Classic Carburettors is not liable for any indirect or consequential losses or expenses suffered by the purchaser or any third party, howsoever caused, including but not limited to loss of turnover, profits, business or goodwill or any liability to any other party.
Classic Carburettors shall not be liable for any claim, loss or expense sustained or incurred by any person arising in any way as a result of the unavailability of products or any delay in delivery of the products or any part thereof or any failure to deliver the products or part thereof.
Any advice, recommendation, information or representation provided by Classic carburettors as to the quality or performance of the products or their suitability for a particular purpose or otherwise in relation to the products is given in good faith but without any liability or responsibility on the part of Classic Carburettors. The purchaser acknowledges that it has not relied upon or been induced by any representation of Classic Carburettors.
Warranty Coverage
Subject to the terms and conditions below, Classic Carburettors warrants that products imported, sold, distributed and repackaged; together with items rebuilt, refurbished and remanufactured by it (“Products”) shall be free from defects in material and/or workmanship for the applicable manufacturers Warranty Period.
The Warranty does not cover the following:
(a) Your tax obligations;
(b) The cost of labour for installation of replacement parts;
(c) Any defects to the vehicles to which the Classic Carburettors Product is attached/fitted;
(d) The costs of a third party repairer or third party supplier;
(e) Consequential loss, including but not limited to any of the following:
(i) Shipping charges for replacement parts;
(ii) Transportation costs to bring the Products to Classic Carburettors premises;
(iii) Travel to and from repair sites;
(iv) Damages related to loss of use;
(v) Demurrage expenses; and/or
(vi) Damages to property or other equipment including crops and public or private roads.
Warranty Period
The Warranty Period commences from the Date of Supply of the Products to you. This Warranty terminates at the expiration of the period stipulated on the Product Details page. Any Warranty claims made pursuant to Clause 4 of this Warranty must be received by Classic Carburettors within the Warranty Period.
Classic Carburettors’s Warranty Obligations
Classic Carburettors must respond to your Warranty claim within a reasonable time. Classic Carburettors may in its absolute discretion inspect the Products for the purposes of identifying the cause of the defect complained about in a Warranty claim. Your exclusive remedies under this Warranty during the Warranty Period shall be, at Classic Carburettors’s sole discretion:
(a) Repair; or
(b) Replacement; or
(c) Payment of credit for the original purchase price of the Products.
Costs of Warranty claim
If Classic Carburettors requests to inspect the Product for the purposes of your Warranty claim, you must deliver the Product to the Classic Carburettors premises at your own cost. Classic Carburettors may in its absolute discretion require you to pay its costs of labour and any parts related to an inspection by Classic Carburettors of your Products which was undertaken as a result of your Warranty claim. If Classic Carburettors inspects the Products pursuant to your Warranty claim and discovers a defect which is covered under this Warranty, Classic Carburettors will not charge you the costs of that inspection.
Conduct which voids this Warranty
This Warranty shall not apply if any fault, flaw or deficiency has been caused by (whether partially or fully) or arises from any of the following:
(a) product operator negligence or misconduct;
(b) casualty or accident to the Products;
(c) product used in race, competition, modification or off-highway;
(d) use and/or operation of the products inconsistent with manufacturer’s training and/or operation manuals or equivalent as published and/or advised from time to time;
(e) use and/or operation of the Products exceeding Classic Carburettors’s ratings for the Products including misuse and/or abuse whether intentional or unintentional;
(f) maintenance, catalogue, service and/or repair of the Products inconsistent with manufacturer’s recommended service and maintenance schedules and operations manuals or equivalent as published and/or advised from time to time;
(g) improper installation of Product which is materially inconsistent with manufacturer’s specifications;
(h) unauthorised modifications or alterations you have made to the Products;
(i) transportation damage;
(j) fair wear and tear;
(k) continual use of the product after signs of faulty or damaged product;
(l) product that have had their name, manufacturing number or trade mark removed;
(m) abuse and/or misuse of product including but not limited to:
(i) use of the Product for a purpose which was not the intended purpose you disclosed to Classic Carburettors at the time of supply;
(ii) operation of product with unsuitable or inadequate lubricant or coolant;
(iii) spraying of liquids or substances which corrode the product or are otherwise not recommended by Classic Carburettors;
(v) overloading the product; or
(vi) excessive exposure to extreme weather;
(n) acts of God (including natural disasters); and/or
(o) any use of non-original manufacturer’s parts or equipment
Australian Consumer Law Statement
Our goods come with guarantees which cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Classic Carburettors Release of Liability
The Buyer agrees and acknowledges that property which is the subject of this sale is accepted on an "as is" basis and "with all faults, if any". The seller, Classic Carburettors, expressly agrees to disclose all known defects, faults, repairs or modifications of subject property to any person to whom it conveys sale and possession of property. Property is conveyed subject to NO WARRANTY WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE, from Classic Carburettors to Buyer, nor to any of Buyer's employees, agents, or transferees. The Buyer ACCEPTS PROPERTY AS IS, WITH ALL FAULTS, OBVIOUS AND LATENT, AS MAY BE DISCOVERED AT THE TIME OF THIS CONVEYANCE OR SUBSEQUENTLY. Classic Carburettors disclaims any liability for damages or injuries caused by Property while such Property is in Buyer's use and possession or after Buyer has conveyed them to subsequent purchasers or users. Buyer agrees to indemnify and hold harmless Classic Carburettors against liability, demands or claims arising because of injuries or damages caused by Property, and Buyer agrees to include a provision in any future agreement conveying Property which states, "subsequent Buyer or user (as appropriate) agrees to indemnify and hold harmless Classic Carburettors for any liability, demands or claims arising because of injuries or damages caused by Property which is the subject of this Agreement.
